This Agreement is made between Integrity Property Solutions, LLC and: __________________________________ referred to as “Client”. If the Client is married, client represents that his obligation is a family obligation incurred in the interest of the family.
In consideration of the promise and terms of this Agreement, the parties agree as follows.
The Client agrees to pay a fee of $___________ for the home inspection of the “Property”, being the residence, and garage or carport if applicable. Located at: ___________________________________________________________.
Integrity Property Solutions, LLC. Agrees to conduct a home inspection for the purpose of informing the client of visual observations of major home deficiencies of the inspected systems and the times at the time of the inspection only. THE WRITTEN REPORT IS THE PROPERTYOF INTEGRITY PROPERTY SOLUTIONS, LLC AND THE CLIENT AND SHALL NOT BE USED BY OR TRANSFFERRED TO ANY OTHER PERSON OR COMPANY WITHOUT BOTH Integrity Property Solutions, LLC and the Clients written consent. 1) This home inspection of the subject property shall be performed by Integrity Property Solutions, LLC for the Client with applicable sections of the Standards of Practice of the National Association of Certified Home Inspectors, Inc. 2) The purpose of this inspection is to identify and disclose visually observable major home deficiencies of the inspected systems and items at the time of the inspection only. Detached buildings are not included. 3) This inspection is not intended to be technically exhaustive not is it considered to be a GUARANTEE OR WARRANTY, EXPRESSED OR IMPLIED, REGARDING THE CONDITIONS OF THE PROPERTY, ITEMS AND SYSTEMS INSPECTED AND IT SHOULD NOT BE RELIED ON AS SUCH. Neither Integrity Property Solutions, LLC nor its inspector shall be held responsible or liable for any repairs or replacement with regard to this property, systems , components, or the contents therein. Company is neither a guarantor nor insurer. 4) THE INSPECTION AND REPORT DO NOT ADDRESS AND ARE NOT INTENDED TO ADDRESS THE POSSIBLE PRESENCE OF OR DANGER FROM ASBESTOS, RADON GAS, LEAD PAINT, UREA FORMALDEHYDE, SOIL CONTAMINATION, MOLDS AND FUNGUS AND OTHER INDOOR AND OUTDOOR SUBSTANCES. THE CLIENTIS URGED TO CONTACT A COMPETANT SPECIALIST IF INFORMATION, IDENTIFICATION, OR TESTING OF THE ABOVE IS DESIRED. 5) Any matter concerning the interpretation of this agreement, of the Inspection report, or any claim based upon either of them shall be subject to mediation between the parties. The liability of Integrity Property Solutions, LLC, agents and employees shall be limited to the amount paid to Integrity Property Solutions, LLC for inspection services and additional fees. It is further agreed, that under no circumstances will Integrity Property Solutions, LLC be liable for consequential damages of any sort. Failing such mediation shall be resolved by arbitration in accordance with the Construction Industry Arbitration Rules of the American Arbitration Association, except for the rules pertaining to the arbitrator selection. The arbitrator shall have knowledge of the home inspection industry and the arbitrator must be a member of NACHI(National Association of Certified Home Inspectors) with at least five (5) years of Home Inspection experience. This inspection was performed in good faith and to the best of my ability. The client further agrees to pay for any and all legal and defense fees incurred by Integrity Property Solutions, LLC including, agents and employees. Furthermore, any legal action must be brought within 90 days from the date of the inspection or will be deemed waived and forever barred. 6) If any provision of this Agreement is declared invalid or unenforceable by any court, the remaining provisions will remain in effect. This agreement represents the entire agreement between the parties. No change or modification shall be enforceable against any party unless such change or modification is in writing and signed by the parties. This Agreement shall be binding upon and enforceable by the parties and their heirs, executors, administrators, successors and assigns. 7) The inspection service is conducted at the property. The physical on-site inspection of the property is a very valuable time of exchange of information between Integrity Property Solutions, LLC and the Client. Any particular concern of the Client must be brought to the attention of Integrity Property Solutions, LLC before the inspections begins. The written report will not substitute for Clients personal presence during the inspection. It is virtually impossible to fully profile any building with any reporting system. Unless client attends and participates in the inspection itself, the client will have no chance of gaining all of the information that is offered.
The undersigned have read, understood and accepted the terms and conditions of this agreement and agree to pay the charges specified below.
Client agrees to pay a base fee of $______________plus any additional fees not included in the base fee and applicable taxes at or before the time of inspection.
